Eastern District Sacramento Controversy: Chief Judge Morrison England Issues Full-Bench Disqualification Order

Judge Morrison England has issued an unprecedented order disqualifying all judges of the US District Court for the Eastern District of California. 

United States District Court Chief Judge Morrison C. England yesterday issued an order banning every judge of the Eastern District court from hearing a startling motion seeking to undo a 2012 judgment due to elaborate fraud on the court and other egregious misconduct by the government.


"Based on facts alleged in the motion and accompanying Declarations and Exhibits, the impartiality of the District and Magistrate Judges in the Eastern District might reasonably be questioned.
Therefore, on the Court's own motion and pursuant to the Code of Conduct for United States Judges, Canons 2 and 3, in order to avoid the appearance of impropriety, and because a judge has a duty to disqualify him or herself if his or her impartiality could be reasonably questioned, whether or not such impartiality actually exists, the Court recuses itself from the above-captioned case...Accordingly, all District and Magistrate Judges in the Eastern District of California are RECUSED from hearing case number 2:09-cv-02445 and all related matters."
Federal court watchdog Ulf Carlsson was not surprised by the order. "We have been saying for years that virtually every judge on this court has failed or refused to disclose conflicts of interest in civil rights cases, and especially in pro per civil rights cases," Carlsson said. 

"They have finally been forced to admit the obvious. Every judge on this court has professional, social or personal relationships with state court judges, attorneys, and, in this case, federal prosecutors. The relationships constitute a conflict of interest requiring disqualification, which has never happened until now. This is the most corrupt federal court in the United States."

Carlsson and other whistleblowers assert that Eastern District judges have helped conceal a RICO racketeering enterprise operating in Sacramento Superior Court by obstructing civil rights litigation against the RICO conspirators. Federal court judges John A. Mendez, Troy L. Nunley, and Chief Judge Morrison C. England formerly were Sacramento County Superior Court judges.
